These Terms and Conditions apply to (i) the use of the Website paulinagreen.com including subdomains and alternative domains, (ii) all services, memberships, and digital content of the provider, as well as (iii) the establishment and processing of related user relationships for paulinagreen.com and other products and services we offer to users. Take your time and read these lines carefully. This applies to the associated apps, software, and websites. By consenting to and/or using Paulina's services, you agree to these. These terms and conditions apply exclusively to activities with us; third parties and feeder services have their own terms and conditions. Deviating user conditions are only valid with us and only apply if we have expressly agreed to their validity in writing.
Future amendments to these Terms and Conditions may be necessary and may create rights and obligations when using the Services.
„Paulina Grün“ is an AI-based edu-companion for generating ideas for content and planning of teaching and learning settings as well as their further development and design.
It is not a substitute for individual professional, legal, tax or educational advice.
AI-supported content is supportive and non-binding. Binding commitments are only valid if they are expressly stated in writing and signed by both parties.
Any commercial use of the content of paulinagreen.com and all related content created, downloaded, or derived from it is expressly prohibited. Resale of the services by the user, any commercial or non-commercial integration into other platforms, and any other alternative uses – including those via third parties – are therefore not permitted.
Service components include, for example: digital content/guidelines, planning and concept proposals, AI functionality integrated via API (currently OpenAI/ChatGPT), tools and software components including avatars/animations, and protected design/brand/persona elements.
The Paulina Grün content is in beta. Functions, content, and results are subject to change at any time. Errors or limitations are possible. No guarantee of permanent or error-free availability can be given.
The results of the AI-supported functions are to be understood as suggestions and inspirational aids and do not constitute binding recommendations or guarantees of success.
The user decides individually on use and implementation and remains independently responsible for his activities and their consequences and effects.
Institutional use or use by organizations via an individual account is expressly prohibited.
To use the services on Paulinagreen.com, registration is required. The user submits an offer; the contract is concluded upon electronic confirmation via email. A "user account" is created for this purpose.
The information provided by the user and the password created will be used for subsequent business and service communication with Paulinagreen.com.
The user is obliged to immediately inform us of any changes to his account information and contact address. hello@paulinagreen.com
User access is exclusively for the user. The user agrees not to share his/her personal account information or to make the account accessible to anyone else. This also applies to the use of business emails or organizational email addresses. Should someone gain access to the user account without the user's consent, the user is obligated to immediately inform Paulinagreen.com via hello@paulinagreen.com to inform and support the further steps taken.
For free memberships: Contract conclusion via written agreement or use of the test account created for this purpose. This account is clearly marked, can be revoked at any time, and is intended solely for testing purposes or bonus promotions. Commercial use is prohibited.
For paid memberships: Contract is concluded in the checkout by clicking on the order button and receiving a confirmation email.

Prices are final prices according to Section 6 Paragraph 1 Item 27 UStG (small business regulation; no VAT identification).
Payment via Stripe Payments Europe Ltd. (or via WooCommerce or alternative); their terms and conditions apply.
Subscriptions run for the stated period and automatically renew for the same period, unless no later than 23:59 CET on the last day of the current period Cancellation is made in writing (e.g., via account settings or email). Invoices are provided electronically.
Terminations are possible at any time via the Account settings (dashboard). In the event of termination, the contract will end at the end of the agreed term. Access to the services will remain until the end of this term. Fees paid for these services will not be refunded.
If cancellation is not possible in the account settings, this must be done in writing via the Contact form by providing all necessary information.
The statutory right of withdrawal applies according to §§ 11 et seq. FAGG (Federal Law on Consumer Protection). Within the first 14 days of conclusion, the user can cancel the contract without giving reasons.

Digital content: The right of withdrawal expires if we begin execution before the expiry of the withdrawal period, after the user has expressly consented and confirmed knowledge of the loss of the right of withdrawal (Section 18 Paragraph 1 Item 11 FAGG).
Access is personal; access data must be treated confidentially.
Usage is subject to tariff-related quotas (prompt/API quotas, download limits, etc.) according to Fair Use Policy (see Cookie Policy and Privacy Policy
In case of significant exceedance, misuse or automated access, we may throttle, block or terminate (prior notice, where reasonable; in case of misuse such as bot use, mass downloads or circumvention of security measures, immediate notice).
Parts of the content are generated automatically (e.g. OpenAI/ChatGPT) and may be incomplete, incorrect or ambiguous.
Users are responsible for verifying accuracy, suitability, and implementation; educational decisions are made exclusively by qualified professionals.
Legal/technical advice is non-binding. Mandatory statutory liability remains unaffected; legal, medical or financial advice is excluded.
The persona “Paulina Grün” (name, avatar, design, texts, branding) is protected by copyright and trademark law.
Any use outside of any written license granted (imitation, publication, distribution, editing, e.g. on social media platforms) is prohibited without prior consent.
Screenshots, recordings, or AI-generated content may not be shared without permission.
We are clearing a simple, non-transferable, non-sublicensable, limited to the term of the contract, to use the content for your own purposes (private/professional according to the tariff).
Any distribution, publication, or commercial use outside of the scope of the plan requires our prior written consent. Without this consent, any distribution to third parties is prohibited.
Third-party/open source licenses remain unaffected;
We may block access in whole or in part or terminate the contract for good cause, in particular in the event of legal violations, misuse, significant violation of fair use, late payment, or a threat to security.

Fees already paid will be reimbursed pro rata, as far as the blocking/termination not is the responsibility of the user.
We strive to provide the best service and the best possible service. However, the unforeseen can always happen.
Use of the service is at your own risk. Parts of the service (e.g., chat output) are created solely through user interaction and based on the availability and implementation of the third-party provider at the time.
Our liability for losses or damages arising from the contract with us, slight negligence, or in connection therewith is limited to the following amounts: a) up to the amount of the usage fee paid to us by the affected user in the previous six months, or b) up to €80. Whichever is higher.
No limitation shall apply to gross negligence resulting in death or personal injury, fraud or fraudulent misrepresentation, or any matter for which it would be unlawful to exclude liability in whole or in part.
We are not liable for outages or delays caused by third-party providers (OpenAI, Stripe, hosting, and others); their availability applies. Should the user notice any content or actions from third parties that contradict acceptable use, they are obligated to inform www.paulinagreen.com. We reserve the right to stop any services or content of this kind related to our offering.
Availability cannot be guaranteed. We operate on a best-effort basis.
Since our offer is exclusively for non-commercial use, we assume no liability for potential or actual business interruptions or related losses.
Users indemnify us against claims by third parties resulting from their unlawful use or breach of contract; this applies not, unless it is at fault.
Legal and court costs must be assumed as part of the exemption of users.
In the event of events beyond our control (e.g., natural disasters, strikes, power/grid/cloud outages, cyberattacks), performance obligations are suspended for the duration and extent of the disruption; deadlines will be extended accordingly.
Functions may be adjusted provided that the Main performance not essential is impaired.
We will inform you about changes to the general terms and conditions for ongoing long-term obligations at least 30 days by email before the change takes effect. You may object; if you object, the contract will continue until the end of the current term and then terminate.
Price changes will be announced separately; Special right of termination consists.
For changes that are solely beneficial or legally required, information is sufficient. This information must be provided in text form.
Features marked as "Beta" may contain errors and are subject to change at any time.
No entitlement to a specific range of functions or availability for beta features; unless otherwise stated, no separate fee is charged for these.

We are fundamentally not obliged and not willingto participate in proceedings before a consumer arbitration board.
